Your privacy is not a policy point.

It is the foundation of this work.

Boudoir photography is deeply personal. You are trusting us with something vulnerable and intimate, and we do not take that lightly.

These terms exist to make our agreement clear and enforceable. But behind every section is a simpler commitment:

Your experience, comfort, and privacy remain in your control.

If anything feels unclear or raises concern, please reach out before booking. Every question is welcome.


Agreement to Terms

These Terms of Service constitute a legally binding agreement between Art of You Portrait Studios, LLC, doing business as Art of You Boudoir ("Photographer," "we," "us") and the individual booking services ("Client," "you").

By using this website, booking a session, signing a contract, or submitting payment, you acknowledge that you have read, understood, and agreed to these Terms in full.

These Boudoir Terms of Service govern all boudoir, bridal boudoir, and fine art nude photography services provided under the Art of You Boudoir brand.

Where these Terms are silent, the general Art of You Portrait Studios Terms of Service may apply as a secondary reference.


Who We Serve

Art of You Boudoir provides boudoir photography experiences designed exclusively for women.

Our work is centered on creating a private, respectful, and supportive environment where women can explore confidence, femininity, personal expression, and intimate portraiture in a way that feels authentic and empowering.

At this time, Art of You Boudoir does not offer boudoir sessions for men or couples.


Age & Eligibility

Due to the intimate nature of boudoir photography, all boudoir and fine art nude sessions are strictly limited to individuals who are 18 years of age or older.

No exceptions.

A valid, government-issued photo ID is required before any boudoir session begins.

Art of You Boudoir reserves the right to refuse or discontinue a session if age verification cannot be provided or if there is reasonable uncertainty regarding eligibility.

Art of You Boudoir will not photograph minors in any state of undress or intimate context under any circumstances.


Privacy & Confidentiality

Your privacy is our highest priority.

Boudoir images are private by default.

Your photographs will never be sold, shared, licensed, displayed, or used publicly without your explicit written authorization.

Confidential Handling

Art of You Boudoir does not share, sell, or distribute boudoir images to third parties, advertisers, publications, vendors, or commercial entities without separate written consent.

Professional editing and retouching may be performed by Art of You or by contracted retouchers operating under strict confidentiality requirements.

Professional print labs may receive images solely for the purpose of fulfilling purchased artwork and products.

Anonymity

Your identity remains confidential.

Art of You Boudoir does not publicly identify, tag, or disclose client names unless specifically requested by the client.

Digital Security

Private galleries are password protected and shared only with the client.

Gallery links are never posted publicly or shared with outside parties.

Clients are responsible for maintaining the privacy of their gallery access credentials.

Studio Privacy

Art of You Boudoir is a private studio environment.

No session images are displayed, printed, or shared inside the studio without written permission.


Portfolio Use & Image Release

Boudoir portfolio use is strictly opt-in.

No boudoir image will be used for:

• Website display
• Social media
• Marketing materials
• Printed portfolio
• Professional competition entries
• Promotional or advertising use

without your specific written authorization.

If you wish to permit portfolio use, you will be presented with a separate Boudoir Portfolio Release.

This release is entirely optional.

Authorization is image-specific and usage-specific.


Booking & Payment

Boudoir sessions begin with a consultation or discovery conversation before booking is finalized.

Your session date is not reserved until:

• Signed agreement
• Required retainer payment

have both been received.

Verbal conversations, inquiries, email discussions, or social media messages do not constitute a confirmed reservation.

Retainer

A non-refundable retainer is required to reserve your session date.

The retainer is applied toward your total investment and is not an additional fee.

Retainers are non-refundable and non-transferable to another client, though they may be applied toward an approved reschedule under the conditions outlined below.

Remaining Balance

Remaining session fees are due no later than 48 hours prior to your session date.

Product purchases, including albums, prints, and wall art, are invoiced separately following your reveal appointment and must be paid prior to delivery.

Accepted payment methods may include:

• Credit card
• Debit card
• Venmo
• Cash
• Approved payment plans

Personal checks are not accepted.

Chargebacks or payment disputes made without valid cause may result in recovery of collection costs, merchant fees, and reasonable legal expenses.


Cancellation & Rescheduling

We understand that life happens and will always try to work with genuine circumstances.

Cancellation by Client

If you cancel your session, your retainer is forfeited.

If additional session fees have already been paid, the following applies:

  • 15+ Days Before Session - Remaining session fees beyond the retainer are refunded.

  • 8 to 14 Days Before Session - 50% of remaining session fees beyond the retainer are refunded.

  • 7 Days or Less Before Session - No refund will be issued.

Previously ordered products remain non-refundable.

Rescheduling

One reschedule is permitted without penalty when at least 7 days' notice is provided.

Rescheduling with fewer than 7 days' notice results in forfeiture of the retainer and requires a new retainer to rebook.

Emergencies

Illness, injury, or genuine emergencies happen.

Please communicate with us directly.

Whenever possible, we will work with you compassionately and reasonably.

Cancellation by Photographer

If Art of You Boudoir must cancel due to illness, equipment failure, or unforeseen circumstances, you will receive:

  • Full refund, or Priority rescheduling at no additional charge.

No Shows

Failure to appear without communication forfeits the retainer and any balance paid.

No reschedule is offered without full rebooking.


Informed Consent

Consent is the foundation of boudoir photography.

By booking a boudoir session, you acknowledge and consent to being photographed in the styles, wardrobe levels, and creative directions discussed during your consultation.

You are never required to participate in:

  • Any pose

  • Any look

  • Any level of undress

  • Any creative direction

that you have not agreed to.

You may withdraw consent for any pose or direction at any time during your session.

No pressure. No persuasion. No obligation.

Your comfort and autonomy take priority over any photograph.

Participation is voluntary.

You may stop or end your session at any time.

Ending a session early does not entitle a refund, but your emotional and physical wellbeing always come first.

Art of You Boudoir does not accept booking pressure or session direction from spouses, partners, or third parties.

This is your session.

Your consent stands on its own.


Session Policies

Boudoir sessions take place within a private studio environment or approved location discussed in advance.

Who Is Present

Sessions are conducted with only the client and photographer present unless otherwise discussed and approved.

Guests, partners, or companions are not permitted during sessions without prior approval.

Recording

Personal photography, behind-the-scenes recording, or video capture are not permitted without written permission.

Timeliness

Sessions begin and end at scheduled times.

Late arrival does not extend session duration and may affect session scope.

Conduct

Art of You Boudoir maintains a safe and professional environment.

Threatening, abusive, inappropriate, or disrespectful behavior toward photographer or staff results in immediate session termination without refund.

Physical Safety

Posing is guided with safety in mind.

Please immediately communicate discomfort, pain, mobility limitations, or physical concerns.

Your wellbeing comes first.


Image Delivery

All boudoir sessions include a private reveal and ordering appointment.

Final images are delivered following:

  • Reveal appointment

  • Final image selection

  • Payment completion

Delivery Timeline

Digital files and products are typically delivered within 3 to 4 weeks following ordering.

Rush delivery may be available for an additional fee.

Delivery Method

Digital images are delivered through a secure, password-protected gallery.

Physical products are delivered discreetly by tracked shipping or private pickup.

Exterior packaging does not identify session contents.

Image Selection

Art of You Boudoir curates images presented at your reveal appointment.

Not every image captured is shown or delivered.

Only photographs meeting artistic and professional standards are included.

Unedited Files

RAW and unedited files are never delivered or sold.

Gallery Expiration

Online galleries remain active for 30 days.

Clients are responsible for downloading and backing up purchased files.

Gallery restoration may require an archival fee.


Copyright & Licensing

All images remain the exclusive intellectual property of Art of You Portrait Studios, LLC d/b/a Art of You Boudoir and are protected under United States copyright law.

Image purchase grants a personal use license, not copyright ownership.

You may:

  • View and store images privately

  • Print for personal display

  • Share privately with a spouse or partner

  • Enjoy images for personal use

You may not:

  • Sell images

  • Commercially exploit images

  • Submit to stock or third-party platforms

  • Remove watermarks where present

  • Alter images in ways that misrepresent the photographer's work

If you wish to publicly share boudoir images online, we encourage a conversation first, so you feel fully comfortable with your decision.

Image Storage & Archiving

Art of You Boudoir maintains secure archives of client images and purchased artwork files as part of our professional workflow and copyright protection practices.

Maintaining an archive allows us to support future product orders, replacement requests, portfolio administration when authorized, and long-term preservation of artistic work.

Active Archive

Delivered and purchased image files are maintained within an active archive for approximately 1 year following your session date.

During this period, archived files may be available should replacement or recovery become necessary.

Clients are strongly encouraged to download and maintain personal backups of all purchased digital files upon delivery.

Long-Term Archiving

Following the active archive period, Art of You Boudoir may continue to retain delivered images within a long-term archive at our discretion.

Because all photographs remain copyrighted works owned by Art of You Boudoir, archive management, retention practices, and long-term storage decisions remain solely at the discretion of the photographer.

Availability of archived files beyond the active archive period is not guaranteed.

Unselected & Working Files

Images not selected for purchase, rejected images, test captures, duplicate frames, and unedited working files may be permanently removed at the photographer's discretion as part of routine workflow and archive management.

RAW and unedited files are never released or sold.

Archive Security

Boudoir images are stored using secure and access-controlled systems.

Images are never intentionally maintained on unsecured public platforms or distributed outside the privacy protections outlined within these Terms.



Liability

Art of You Boudoir provides a supportive and professional environment but cannot guarantee specific emotional or artistic outcomes.

Participation in a boudoir session carries personal responsibility.

Art of You Boudoir is not responsible for:

  • Personal injury

  • Loss or damage of belongings

  • Client misuse or public sharing of images

  • Circumstances beyond reasonable control

Total liability shall not exceed the amount paid for services provided.

If concerns arise before, during, or after your experience, we encourage direct communication and will always respond with care and professionalism.


Returns, Refunds & Product Policies

Because boudoir photography and artwork are custom-created services and products, all sales are final.

Session retainers, session fees, digital images, albums, prints, wall art, video products, and custom artwork are non-refundable, non-returnable, and non-exchangeable once purchased or ordered.

Session Fees & Payments

Retainers are non-refundable and secure reserved studio time, planning, staffing, and preparation.

Completed photography services are non-refundable.

Product orders and artwork purchases are custom produced specifically for you and therefore cannot be cancelled, returned, or exchanged once production has begun.

Digital Images

Purchased digital files are non-refundable once delivered or made available through your gallery.

RAW and unedited files are never released or sold.

Artwork & Product Quality

Art of You Boudoir carefully partners with professional labs and manufacturers to produce high-quality artwork and albums.

If a product arrives damaged or contains a manufacturing defect, please notify us within 7 days of delivery.

Verified lab or manufacturing defects may be repaired or replaced at our discretion.

Normal variations in color, texture, materials, monitor calibration, or handcrafted production are not considered defects.

Payment Completion

No products, digital files, albums, or artwork will be delivered until all balances are paid in full.


Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Texas.

Any disputes arising from these services shall be resolved exclusively within Williamson County, Texas.

Before formal legal action, both parties agree to attempt resolution through good-faith communication and non-binding mediation.

If any provision of these Terms is deemed unenforceable, all remaining provisions shall remain in effect.

The version of these Terms in effect at the time of booking governs your session.
