These terms exist so that both of us know exactly what to expect; before, during, and after your session. Please read them before booking.

Terms of Service

By using this website, booking a session, signing a contract, or submitting payment to Art of You Portrait Studios, LLC, you acknowledge that you have read, understood, and agreed to the following Terms of Service.

These terms apply to all portrait, boudoir, branding, headshot, and photography services provided by Art of You Portrait Studios.


Privacy & Image Use

Your privacy matters to us.

Art of You Portrait Studios respects the personal nature of every session and takes reasonable steps to protect your information and experience.

By participating in a session, you grant Art of You Portrait Studios permission to display selected images for portfolio, website, social media, print marketing, and professional promotional purposes.

We will never sell your images to third parties or use them in a misleading, exploitative, or disrespectful manner.

If you prefer that your images remain completely private, you may request a Private Session designation at or before the time of booking.

We do not identify or tag clients in photographs unless specifically requested.

Personal information and payment details are kept confidential and are never shared outside of secure payment processing or legal requirements.


Age Requirements

Art of You Portrait Studios photographs both adults and minors under limited circumstances.

Clients under the age of 18 must be accompanied by a parent or legal guardian for the duration of the session.

A valid government-issued photo ID may be required for age verification and identification.

Art of You Portrait Studios reserves the right to refuse or discontinue service if appropriate supervision, consent, or age verification cannot be provided.


Studio Policies & Client Conduct

To maintain a professional, respectful, and safe environment for all clients, the following policies apply:

No Pets or Animals

Pets and animals are not permitted inside the studio unless previously approved for the session.

No Weapons

Firearms, knives, or weapons of any kind are prohibited on studio property.

No Smoking or Illegal Substances

Smoking, vaping, illegal substances, or impairment during a session are prohibited.

Personal Photography

Cell phone photography, personal cameras, or behind-the-scenes recording are not permitted during sessions unless approved.

Guests

Guests or companions must be approved in advance. Unapproved or disruptive guests may be asked to wait outside the shooting area or leave the premises.

Professional Conduct

Art of You Portrait Studios reserves the right to refuse or discontinue service without refund if behavior is threatening, abusive, harassing, unsafe, or otherwise inappropriate toward the photographer or staff.


Booking, Retainers & Payment

Your session date is not reserved until both of the following have been received:

  • Signed session agreement

  • Required retainer payment

Verbal agreements, inquiries, social media messages, or email conversations do not constitute a confirmed booking.

Retainers are non-refundable and are applied toward your total investment.

Remaining balances are due according to the terms outlined in your individual session agreement and must be paid before services or product delivery.

Accepted payment methods may include credit cards, debit cards, financing, digital payment services, or cash as outlined during booking.

Chargebacks or disputed payments made without valid cause may result in collection efforts and recovery of applicable merchant, legal, and collection fees.


Cancellation & Rescheduling

We understand that life happens and will always try to work with reasonable circumstances.

Rescheduling

Clients may reschedule once without penalty when reasonable advance notice is provided.

Rescheduling requests made with limited notice may require a new retainer or rescheduling fee.

Cancellations

Retainers are non-refundable.

If a session is cancelled, refund eligibility for any payments beyond the retainer is governed by your signed session agreement.

No Shows

Failure to appear without communication forfeits all monies paid and requires full rebooking.

Photographer Cancellation

If Art of You must cancel due to illness, scheduling conflict, or circumstances within our control, clients will receive either:

  • Full refund, or

  • Priority rescheduling at no additional cost

Weather or circumstances beyond either party's control will be rescheduled whenever possible.


Session Expectations

Sessions begin and end at scheduled times.

Late arrivals may result in shortened coverage without refund or may require rescheduling depending on schedule availability.

Session plans, locations, wardrobe changes, and overall scope are discussed during consultation and confirmed prior to the session.

Requests for major additions or changes on the session day may not be possible.

Art of You cannot guarantee specific poses, expressions, or exact image outcomes, though every reasonable effort is made to fulfill the session vision discussed together.


Image Delivery & Archiving

Following your session, images are professionally curated and edited to meet our artistic and technical standards.

Not every image captured will be presented or delivered.

Delivery Timeline

Digital files and print products are typically delivered within approximately 3 to 4 weeks following image selection and full payment.

Rush delivery may be available when scheduling permits.

Image Selection

Art of You Portrait Studios maintains full creative discretion regarding image selection and final editing.

Unedited Files

RAW or unedited image files are never released or sold.

Online Galleries

Online galleries remain active for a limited period following delivery. Clients are responsible for downloading and backing up purchased digital files.

File Retention

Session files are generally archived for approximately six months following delivery.

After this period, files may be permanently deleted without notice.

Clients are strongly encouraged to maintain their own backups.


Copyright & Image Licensing

All photographs created by Art of You Portrait Studios remain the exclusive intellectual property of Art of You Portrait Studios, LLC and are protected under United States copyright law.

Purchasing images grants a personal use license, not ownership of copyright.

Clients may:

  • Print images for personal display

  • Share images on personal social media

  • Use purchased business images for professional branding or personal websites when applicable

Clients may not:

  • Sell or sublicense images

  • Submit images to stock agencies

  • Remove watermarks where present

  • Alter or heavily modify images in a manner that misrepresents the photographer's artistic work

  • Reproduce, scan, copy, or distribute images beyond the granted license

Commercial advertising or licensing use may require separate written authorization.


Artistic Style & Creative License

Art of You Portrait Studios carefully curates and edits every image to reflect our professional standards and artistic vision.

Editing style, image selection, and final presentation remain at the photographer's sole discretion.

Only images meeting our artistic and technical standards will be delivered.

By booking, you acknowledge familiarity with our portfolio and editing style.


Returns & Refunds

Because photography and artwork are custom-created services and products, all sales are final.

No refunds, returns, or exchanges are available once digital files, artwork, or print products have been delivered or ordered.


Limitations of Liability

Participation in photography sessions carries inherent risks.

Clients assume responsibility for personal safety and for communicating any medical concerns, injuries, mobility limitations, or physical restrictions prior to the session.

Art of You Portrait Studios is not responsible for:

  • Personal injury

  • Loss or damage to personal belongings

  • Circumstances beyond reasonable control

  • Subjective dissatisfaction when services have been performed in good faith

To the fullest extent permitted by law, Art of You Portrait Studios' total liability shall not exceed the amount paid for the services involved.

If concerns arise, we encourage direct communication and will always make reasonable efforts to reach a fair resolution.


Affiliate Links & Third-Party Content

Our website or communications may occasionally include links to third-party products, services, or affiliate recommendations.

Art of You Portrait Studios is not responsible for the content, policies, reliability, or performance of third-party websites or offerings.

Use of external links is at your own discretion.


Governing Law & Dispute Resolution

These Terms of Service are governed by the laws of the State of Texas.

Any disputes arising from services or use of this website shall be resolved exclusively in Williamson County, Texas.

Before formal legal action, both parties agree to attempt resolution through good-faith communication.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.

The Terms of Service in effect at the time of booking govern your session.
